A sign that spells a million miseries for the native people of Sarawak
Huang Lung Ong was the lawyer representing the Hii family in their attempt to sell 32,000 hectares of forested land licensed for plantation under their company Billion Venture.
He was caught on video saying the family would arrange to pay Chief Minister Taib Mahmud 10% for the ‘favour’.

Sarawak Report can now further reveal that this lawyer appeared to be withholding crucial evidence from his prospective buyer.
Because the Billion Venture concession is a major ‘hot potato’ of native unrest in Sarawak and the matter returns to court this very Wednesday!

come together to challenge the State Government’s alienation of their lands without consultation or due process under the law.
These communities are the Penan, Kelabit and Lun Bawangs, who live in the Upper Limbang region.
This was an area of pristine jungle till the late 1980s when Taib savagely cracked down on the blockades against the invading loggers, whom he had handed the licences to.
But Huang wasn’t telling the ‘buyer’, it seems, who was being asked to pay a whopping RM230million for the company that the plaintiff communities say has no right to the land the Hiis are trying to sell.
Instead he indicated to the investigators from the NGO Global Witness that there was no serious problem with the title to the land.

The complaint by the NCR land owners is that Billion Venture was secretly handed the NCR land belonging to no less than three communities in the Limbang region by the Chief Minister back in 2002.
The concession consisted of a Planted Forest Licence LPF/0027, as well as two lucrative Belian timber concessions nearby.
And yet neither the Chief Minister, the Land and Survey Department nor the company itself informed the local people that the transaction had taken place.
Taib’s Land and Survey Department did not warn the local people their land was being considered for a logging and plantation concession.  They did not notify them of the concession.  They did not provide legal support or advice. They did not attempt to negotiate a compensation settlement with the native customary land rights owners.
All this was in breach of the law and the constitution, as the case between these communities against Billion Venture Sdn Bhd as well as against the State Governement for issuing the licences explains.

Suit against Taib’s State Government for acting unconstitutionally in handing out the licences without formally applying to extinguish the existing NCR land rights of the native communities, who had lived there “since time immemorial”.
Rather than applying to extinguish the native rights and approaching the landowners in the proper way, the licence holders instead sat on the secret transaction for a number of years, so that the first the local people knew of what Taib had done was when bulldozers turned up to log and destroy the region.
How many times have we heard of that trick being carried out in Sarawak and what mockery it makes out of Taib’s feeble claims last week that everything in Sarawak is done “according to procedure“.

By the time these isolated communities had found out that their land had been signed away from them, first under a timber concession to the Samling-linked Ravenscourt Sdn Bhd and then as a plantation licence to Billion Venture, it was already too late.
And by the time that they had then managed to get legal advice and make a case, these wealthy companies and Taib’s Land & Survey Department lawyers were able to argue that the period for complaining had expired!
The defence put forward by Taib, the Hiis, the Yaws of Samling and the other defendants in this case therefore, is not that they didn’t break the law, because it is perfectly obvious they did.
Their defence is that the villagers left more than the 36 month period allowed for complaints under the Statute of Limitations, so the law cannot be enforced!
It is truly shocking that the original trial judge felt bound to accept this outrageous excuse to turn down the original case on such a technicality, rather than being able to examine the merits of the case.

Their faut they didn’t hire a lawyer in time about something no one had told them had happened?
Because the NCR land owners were unable to complain in time and only brought their petition in 2011 the judge formally disallowed their case!
But how were these poor people able to complain if no one had told them what had happened and if the licences had been kept quiet?
And how are isolated communities who cannot often read or write and who have no money suddenly to be expected to hire lawyers to fight their case?
Clearly, it was the bounden duty of Taib as the leader of the state to make sure that the NCR landowners were kept fully informed of his plans and decisions and given access to legal advice and the compensation process.
Instead he chose to breach the procedures laid out in the constitution and to plunder the lands of these poor people instead. The act was nothing short of deliberate fraud and Taib and his cronies have carried out such frauds all over Sarawak for the past 30 years of his rule.

The PKR leader Baru Bian is the lawyer who has represented the people of Limbang against Billion Venture for the past 6 years.

However, the people of Limbang are doggedly resisting defeat in this matter and the genocide and destruction it would bring.
The Limbang case is one of the clearest examples of injustice against NCR landowners in Sarawak and it unites thousands of people from different native communities working together for the first time against the greed and deceit of Taib’s regime.

Despite being let down by a legal system, which in Malaysia has become corrupted by political interference, they have refused to accept the dismissal of the case.
After all, Taib’s controversial land laws have also now been held to be unconstitutional in the Federal High Court.
Why should the Chief Minister get away with robbing his people on such a flimsy technicality?
The communities have been championed all the way in this case by the landrights lawyer and PKR leader Baru Bian and they have now successfully been granted an Appeal to contest the dropping of the case.
And, given the increasing pattern of success of these “naughty” Native Land Rights cases, owners like the Hiis must be getting a little uncomfortable about coming back to trial once more.

After all, as an election approaches, everyone can see that what they and Mr 10% (Taib Mahmud) got up to was evil, wrong, immoral ….. oh and yes unconstitutional.
Of course it is still uncertain whether the courts will at last have the guts to correct such vast injustices as this.
After all, Taib and his friends and family have chosen so often to label rightful land owners as “squatters”, in order to alienate their territories and sell them off themselves for billions.
Yet, land rights lawyers have observed that it is clear that some judges are unable to appreciate how important Native Customary Rights remain to the natives, that they are prepared to allow legal technicality to override fundamental rights in an issue that means life or death to the natives of Sarawak.
The native people can hope for justice on Wednesday, but the real place to deal with such issues is not in Sarawak’s corrupted court system, but through a change in government.
The Hii’s vulgar Billion Venture plans could yet be nipped in the bud if the people can overcome Taib’s election-rigging tactics over the coming few weeks.

Sekarang ini sudah termaklum ramai bagaiman Ragad Kurdi adalah isteri yang kurang hormat dan belum pandai beradab melayan suami.

Tetapi bagaimanakah Ragad Kurdi boleh menjadi isteri YAB pemimpin tercinta?

Sejarahnya adalah perkahwinan Ragad Kurdi dengan pemimpin tercinta adalah manipulasi Robert Geneid.  Dengan kembali isteri YAB kepada Rahmatullah, Robert Geneid mula mencari 'replacement' untuk mengisi kekosongan hidup YAB.

Selama ini Robert Geneid dengan pengaruhnya terhadap YAB sudah mengaut berbilion-billion dari bumi sarawak.  Robert Geneid menghasut dan memperdaya YAB bahawa dialah yang paling boleh dipercayai oleh YAB.

Dengan kekosongan dalam rumah YAB maka Robert Geneid merasakan inilah pelaung 'keeemasan'nya untuk menguatkan lagi 'gripnya' terhadap YAB.

Apabila adik YAB Datuk Paul cuba untuk mencari 'calon' isteri dari Indonesia untuk YAB maka Robert Geneid 'block' langsung YAB untuk berjumpa dengan calon Datuk Paul itu.  Dengan itu Robert Geneid 'bekerja cepat' untuk meletakkan calonnya sebagai 'isteri' YAB sebelum adik-beradik YAB menawarkan calon 'yang lain'.

Robert Geneid mencari di antara keluarganya sendiri untuk menjadi isteri YAB.  Walaupun sebenarnya budaya kaum Robert Geneid berlainan dan mungkin kurang sesuai dengan budaya peradaban lembut melayu/melanau namun Robert Geneid tetap nekad.

Oleh kerana waktu terdesak Robert Geneid tidak menunggu untuk mencari anak 'dara' dia mencari bekas isteri orang pun boleh.  Janji cepat.  Masih menjadi pertanyaan sampai sekarang tetapi dikatakan bahawa apabila memperkenal]kan Ragad Kurdi kepada YAB Robert Geneid 'lupa' untuk memberitahu bahawa bukan sahaja Ragad Kurdi adalah bercerai tetapi juga mempunyai dua orang anak.  Adalah terbukti bahawa dari permulaan jumpa sehingga akad nikah anak-anak Ragad Kurdi tidak pernah 'muncul' atau 'nampak' di Kuching.  Robert Geneid hanya berasa 'selamat' untuk perkara diketahui 'selepas' calonnya Ragad Kurdi 'sudah' menjadi isteri YAB.

Hii King Chiong top illegal logging boss in northern Sarawak?


 Di khabarkan bahawa business partner Datuk Robert Geneid dalam Rich Venture Construction Sdn Bhd adalah antara 'tauke' illegal logging terbesar di utara Sarawak.

Hii King Chiong adalah paymaster atau 'sponsor' kepada beberapa gangster di miri dan utara Sarawak.  Hii King Chiong dan syarikat-syarikat miliknya mendapat beberapa ratus ribu ekar konsesi balak dengan 'lobbying' Datuk Robert Geneid.  Hii King Chiong of Kingwood and Fonsen Group of companies which are dealing in timber, oil palm, sago, property,construction, shipping and hotel businesses in Malaysia and overseas.

Tidak cukup dengan itu Hii King Chiong memotong balak secara haram atau 'rompak' berpuluh ribu ekar di pertengahan dan utara Sarawak.  Perbuatan-perbuatan ini adalah rompakan kerana bukan sahaja royalti/cukai kepada kerajaan negri todak dibayar atau 'undeclare' tetapi juga pampasan kepada orang kampung tidak dibayar.

Antara gangsters yang di'biayai' oleh Hii King Chiong untuk pembalakan haram 'perompakan' adalah Achiko.  Achiko dan gangsternya sudah terlibat dalam beberapa kes pembunuhan dan serangan ganas terhadap orang kampung yang membantah kegiatan pembalakan haramnya.

Sejak tahun lepas Hii King Chiong dan gangster-gangsternya merompak balak di 'Marau Forest Reserve'.  Iaitu bukan sahaja hutan yang mereka tidak diberi lesen oleh kerajaan tetapi juga hutan yang di gazetkan oleh kerajaan sebagai 'protected'.  Kaum Lakiput di kawasan itu jugan tidak diberi pampasan seperti mana dalam laporan akhbar Utusan Sarawak November 2011 berjudul, "Kaum Lakiput tuntut pampasan dari syarikat pembalakan".

Give 40 per cent discount, Laku urged

MIRI: The Consumers Association of Miri (CAM) wants Northern Region Water Board (Laku) to give a 40 per cent discount for the water bill this month in consideration of the inconveniences caused by the recent water supply disruptions here.
Its president George Bennett Francis said although the water situation is back to normal, the request for discount was based on the eight universal rights of consumers which the water board had infringed.
“Laku has infringed the Rights of Consumers for the disruption of supply without notice or given the facts or information by way of public statement (through radio or SMS) in such time of emergency needed for consumers to make informed choices or decisions; for the contamination of supplies, including the rights to be protected against products, production processes and services which are hazardous to health or life.
“It includes concern for consumers’ long term interests as well as their immediate requirements,” George said in a statement emailed to thesundaypost yesterday.
He added that the discount was within the right of redress for consumers, which means the right to fair settlement or just claim. It included the right to receive compensation for representation of contaminated water or unsatisfactory services.
George pointed out that the incident also infringed the right to a healthy environment, meaning the right to a physical environment that will enhance the quality of life.
It included protection of environmental dangers over which the individual has no control, like the storage of diesel for the premix plant. It acknowledged the need to protect and improve the environment for the present and future generations.
“If the culprit is found guilty by court for the spillage of diesel into the water catchment, the fine will certainly go to the federal coffer and will not directly benefit the affected consumers, so it is for the availability or acceptable form of legal aid or redress for such a small claim of 40 per cent bill discount.”
George added that during the disruption, consumers who didn’t have any stock of water at all became distraught and panicky when taps went dry with the question of how long will it be. They were forced to buy mineral water to meet the essentials, like for cooking rice, washing dishes, and milk for little children.
“I am told the 500ml bottled mineral water normally cost RM8 or RM9 per box was first raised to RM13 and then to as high as RM25 per box in certain places. Imagine if it is RM13 per box and each family buys 5 boxes, that’s RM65, well beyond a normal household bill per month.
“After restoration, the tap waters were coloured and polluted, and smelled of diesel for a long time, so substantial quantities were flashed off by the consumers.”
The water supply disruption last Sunday affected some 300,000 consumers in Miri and Sibuti due to an oil spill into Sungai Liku, which is Laku’s water catchment area. It thus forced the Lambir Water Treatment Plant to shut down for a day.
Laku, said George, must always protect the consumers’ right for uninterrupted supply of water, and ensure consumers are not inconvenienced.
He said the lesson learnt was one of “incompetence and inability” to plan the location of the premix plant, which is said to be located ‘outside the catchment gazetted area’.

Pencemaran air, Miri terjejas

MIRI: Lebih 300,000 penduduk di bandar raya Miri dan Daerah Bekenu semalam terjejas bekalan air bersih selepas sumber air di Sungai Liku tercemar oleh tumpahan minyak diesel daripada tangki simpanan minyak sebuah syarikat swasta yang terletak dua kilometer dari sungai tersebut.
Dianggarkan, sejumlah 14,000 liter minyak diesel yang digunakan untuk proses penurapan jalan yang disimpan di dalam tangki milik syarikat berkenaan, tumpah ke tanah dan seterusnya mengalir ke Sungai Liku, selepas saluran tangki tersebut bocor dan tidak disedari oleh para pekerjanya.
Pengurus LAKU Management Sdn Bhd (LAKU) Kawasan Miri, Lo Su Onn yang ditemui di Loji Perawatan Air LAKU di Lambir semalam memberitahu, pencemaran itu disedari oleh pekerja loji berkenaan pada jam 8.30 malam kelmarin apabila terhidu bau diesel yang kuat dari kawasan pengambilan air.
Sebaik menyedari terdapatnya tumpahan minyak, kakitangan yang bertanggungjawab menyelenggara loji ketika itu bertindak menutup operasi loji serta-merta bagi mengelak air yang telah tercemar terus memasuki kawasan penapisan dan rawatan.
“Pihak kami mula mencari punca pencemaran awal pagi tadi (semalam) dan mendapati punca tumpahan adalah daripada sebuah syarikat membuat tar jalan. Serentak itu, kita memaklumkan kepada pasukan bertindak mengenai tumpahan minyak untuk mendapatkan bantuan segera,” katanya.
“Sekarang (pagi semalam) kita bergantung kepada sumber bekalan air yang sudah dirawat di loji tangki simpanan sedia ada untuk membekalkan air kepada penduduk Miri.
“Namun, jumlah air bersih yang disimpan di tangki berkenaan agak terhad. Ia menyebabkan kita terpaksa mengurangkan penyaluran air untuk penduduk di bandar raya Miri mulai tengah hari supaya bekalan air tidak putus,” katanya.
Bagaimanapun, menurut Lo, bukan mudah bagi pihaknya membersihkan pencemaran itu kerana tumpahan minyak terbabit sudah meresap ke dalam tanah dan mengalir di sepanjang sungai tersebut.
LAKU, katanya, terpaksa mengepam air dari Sungai Bakong untuk disalurkan ke Sungai Liku bagi membersihkan tumpahan minyak di sepanjang kawasan hulu sungai berkenaan.
Tambahnya, bekalan air dijangka pulih jam 8 malam ini.
Sementara itu, Pasukan Bertindak Kecemasan bagi Tumpahan Minyak daripada Sarawak Shell Berhad (SSB) yang diketuai oleh Pegawainya, Martin Entamin dan Petronas Carigali yang diketuai oleh Zaffeer Ahmad Kiprawi turut tiba di loji bersama peralatan untuk menampan serta menyedut tumpahan minyak.
Kedua-dua pasukan turut dibantu oleh anggota daripada Jabatan Pertahanan Awam Malaysia (JPAM) dan Jabatan Bomba dan Penyelamat yang berada di kedua-dua lokasi iaitu loji perawatan air dan punca tumpahan minyak.
Peralatan menyedut minyak terkini, ‘Mantaray’ terpaksa digunakan dalam operasi tersebut.
Sehingga jam 5 petang semalam, kerja-kerja menghalang tumpahan dan pembersihan di loji perawatan masih dilakukan.
Turut berada di lokasi meninjau keadaan ialah Menteri Muda Komunikasi, Datuk Lee Kim Shin.
Dalam pada itu, penduduk di Miri mulai mengalami ketiadaan bekalan air bersih sekitar jam 1 petang semalam, sekali gus menyebabkan ramai penduduk terpaksa membeli air mineral yang dibotolkan.
Berita ketiadaan air yang diuar-uarkan menerusi laman sosial, media elektronik telah menyebabkan pembelian panik air mineral yang dibotolkan, sehingga barisan panjang di beberapa buah pasar raya.
Tinjauan Utusan Borneo turut mendapati beberapa buah premis kecil dan pasar raya telah kehabisan stok air mineral.
Di kawasan Pujut 7, air mineral dijual di tepi jalan seperti menjual buah durian sehingga menimbulkan kesesakan jalan raya kerana diserbu orang ramai.

Chin persoal loji ‘premix’ dekat Sungai Liku

MIRI: Menteri Tenaga, Teknologi Air dan Hijau, Datuk Seri Peter Chin Fah Kui semalam mempersoalkan lokasi loji ‘premix’ untuk membuat tar jalan yang didirikan berhampiran dengan sumber air di Sungai Liku, dekat sini.
“Patutkah loji yang mendatangkan pencemaran terhadap Sungai Liku dibenarkan terus di situ? Tanpa pendekatan yang menyeluruh dalam menangani pencemaran ini, kita akan terdedah dengan pencemaran, bukan sahaja di Miri bahkan di tempat lain,” kata-nya ketika dihubungi melalui e-mel semalam.
Beliau mengulas mengenai pencemaran air di Sungai Liku yang berpunca daripada tumpahan minyak diesel dari sebuah kilang ‘premix’ berhampiran, menyebabkan lebih 300,000 penduduk Miri dan Bekenu terputus bekalan air kelmarin apabila Loji Perawatan Air Modul 4 di Lambir terpaksa ditutup sementara waktu bagi meng-elak tumpahan masuk ke dalam sistem rawatan.
Loji ‘premix’ berkenaan terletak kira-kira dua kilo-meter dari Sungai Liku, yang merupakan salah satu sumber air utama di Miri dan Bekenu.
Chin yang juga Ahli Parlimen Miri berharap, pihak berkuasa akan melaksanakan tindakan penguatkuasaan yang tegas terhadap punca pencemaran dan mengesyorkan tindakan yang wajar diambil serta-merta.
“Selagi kita bertolak ansur dalam perkara membabitkan pencemaran alam sekitar, selagi itulah kita akan berhadapan dengan masalah seumpama ini nanti,” katanya sambil menambah, langkah berhati-hati perlu diutamakan khususnya membabitkan alam sekitar.
Sementara itu, Setiausaha Politik beliau, Datuk Sebastian Ting berkata, insiden tersebut harus dijadikan pengajaran kepada semua.
“Dua perkara yang kita pelajari iaitu, penduduk panik kerana khabar angin dan kurangnya sistem penyampaian maklumat untuk memaklumkan situasi sebenarnya dari masa ke semasa,” ujarnya.
Sebastian berkata, semua jabatan kerajaan atau agensi harus mempunyai sistem penyampaian maklumat yang pantas dan telus bagi mengelak sebarang penyebaran khabar angin yang kurang tepat.
“Sistem penyampaian yang telus amat penting terutama dalam mana-mana krisis seperti ini,” katanya sambil menegaskan, menjadi tanggungjawab agensi atau jabatan menyediakan maklumat kepada rakyat.

HAVING GOT RID OF DATOK ONN MAHMUD OUT OF SARAWAK AND DATO ARIP DEAD AND BURIED,  WHO THEN WITHIN THE MAHMUD FAMILY MIGHT  POSE A SERIOUS COMPETITION TO ROBERT GENEID’S STRANGLE HOLD ON TAIB?  ROBERT SAW COMPETITION IN THE PERSONS OF SULAIMAN RAHMAN TAIB.  EARLIER  THAN SULAIMAN WAS A FEMALE MEMBER OF THE MAHMUD FAMILY, DATIN AISHAH.  SHE WAS MADE BY TAIB ONE OF THE TRUSTEE’S FOR PBB  (PARTI BERSATU BUMIPUTERA).  STRANGELY NEITHER AISHAH NOR THE PBB BENEFITED FROM THAT RELATIONSHIP.  IN FACT SHE WAS MANAGING PBB  KUCHING OFFICE  ON A VERY  TIGHT AND LEAN BUDGET.  SHE NEVER GOT  A SINGLE  TIMBER CONCESSION  OR  A SINGLE OIL PALM PLANTATION OR A SINGLE CONTRACT  FROM THE STATE OR TAIB. 
ON BEHALF OF PBB SHE WAS ALLOCATED A SMALL PIECE OF LAND IN BINTULU TO DEVELOP INTO RESORT APARTMENTS.  THE PROJECT WAS GOING WELL  UNTIL  IN 1996 WHEN ROBERT  AND WIFE WHO AT THAT TIME TRIED AT ALL COSTS  TO BE TAIB’S ONLY CONFIDANTS AND  ADVISERS  STARTED  FABRICATING LIES AND  CONCOCTING UNTRUTHS TO MAKE TAIB DISLIKE DATIN AISHAH.  ROBERT AND HIS ALLIES  SABOTAGED  AISHAH’S  BINTULU PROJECT AND FORCED HER INTO GIVING UP AND LEAVE  SARAWAK.  SHE NOT ONLY  MADE TO LOSE MONEY ON THE PROJECT BUT HER NAME WAS INTENDED TO BE DRAGGED THROUGH THE MUD.  FOR THE SAKE OF HER MOTHER AND TO AVOID  INFIGHTING WITH FAMILY MEMBERS  AISHAH  GAVE UP  AND  LEFT SARAWAK.   THUS ROBERT ONCE AGAIN SUCCEDED TO ALIENATE  ANOTHER MEMBER OF MAHMUD FAMILY  FROM THE CENTER OF POWER.
SULAIMAN TAIB, TAIB’S 2ND SON, WAS ASKED  TO MANAGE  CAHAYA MATA SARAWAK SOON  AFTER HE RETURNED TO SARAWAK AFTER GRADUATION.  SULAIMAN WAS A CONCIENTIOUS YOUNG MAN WHO SOONER OR LATER RAN INTO PROBLEM WITH ROBERT’S  WAY OF MANAGING OR  MISMANAGING CAHAYA MATA SARAWAK. THERE WAS  OFTEN FRICTIONS BETWEEN SULAIMAN’S AND ROBERT’S WAYS AND DATOK ONN’S WAYS  IN CMS. THIS MEANT  FINAL BUSINESS DECISIONS HAD TO BE REFERRED TO TAIB’S  ATTENTION.  FEW TIMES TAIB WOULD SIDE WITH ROBERT AND  MADE SULAIMAN  LOST FACE.  THERE WERE OCCASIONS OF UGLY SHOUTINGS  AND  THREATS  BETWEEN THEM AND  SUBTLE INSTIGATION  CREATED MISTRUST AND  ILL FEELING BETWEEN SULAIMAN AND ROBERT..   AFTER SEVERAL OF SUCH UNPLEASANTNESS SULAIMAN DECIDED TO SPEND LESS AND LESS TIME IN  CMS AND LIKEWISE LESS AND LESS TIME IN SARAWAK.  AGAIN  FOR THE  4TH TIME  ROBERT SUCCEDED TO DRIVE FAMILY MEMBERS OUT OF SARAWAK  - FIRST  TAIB ‘S BROTHER DATOK ONN, THEN TAIB’S SISTER AISHAH,  THEN TAIB’S YOUNGEST BROTHER DATOK ARIP  THEN TAIB’S  VERY OWN SON, SULAIMAN.   ROBERT SUCCESS IN DRIVING MAHMUD’S FAMILY MEMBERS OUT OF SARAWAK HAS SUBSTANTIALLY  BENEFITTED ROBERT AND HIS FAMILY  IN MORE WAYS THAN ONE . BUT  IT DOES NOT END HERE.
